Contempt

When someone files a contempt motion, it means they are asking the

Judge to punish someone because they believe a court order has been violated.

Contempt only comes into play after a judgment, order, or decree has been

signed by a Judge. The following types of contempt often occur during or after

a divorce:


. Violating a restraining order or preliminary injunction

• Not paying child support that has been ordered

• Not paying spousal support that has been ordered

• Refusing to allow the other parent visitation as ordered in the

parenting plan

• Failure to return the child to the other parent at the end of the

visitation period


Once a Court has issued an order, it is important to follow the order to

the best of your ability and, at the same time, be aware of any potential

violations on the part of the other parent/ex who is subject to the Order.

Courts have been known to take it personally when a parent disregards one of

their orders.


If you believe your Court Order or Judgment is being violated, contempt

may be your best option. And, should you decide to enlist our help with filing

party if he/she is found to have violated the Order.
